Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the skin analysis tool at skin.eliasderm.com (the “Service”), operated by Elias Dermatology, LLC (“Elias Dermatology,” “we,” “us”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
The Service is educational, not medical
The Service uses artificial intelligence to analyze a photograph you provide and generate cosmetic skin observations and skincare suggestions. The Service is provided for educational and informational purposes only and is not a medical diagnosis, treatment, or substitute for professional medical advice. AI assessment of photographs has known limitations, may miss findings that are visible only in person, and may produce results that are inaccurate, incomplete, or inconsistent.
If you notice any skin change of concern — particularly a new, changing, painful, bleeding, or non-healing lesion — please schedule a clinical evaluation with a qualified healthcare professional independently of any results from this Service. For medical emergencies, call 911 or go to the nearest emergency department.
Eligibility
You must be at least 18 years of age to use the Service. By using the Service you represent that you are 18 or older, or that you are using the Service with the involvement of a parent or legal guardian.
Acceptable use
You agree not to:
- Upload images of any person other than yourself, except with that person’s informed consent.
- Upload content that is unlawful, infringing, sexually explicit, depicting a minor, or otherwise inappropriate.
- Attempt to disrupt or interfere with the Service, including by automated scraping, abuse of rate limits, or attempting to gain unauthorized access.
- Reverse engineer or attempt to extract underlying models, prompts, or proprietary data.
- Use the Service to provide medical advice to others.
We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms.
Your content; license to operate the Service
You retain ownership of the photograph you upload and any information you submit. You grant Elias Dermatology a limited, worldwide, royalty-free license to use that content solely as necessary to operate, deliver, and improve the Service, including by transmitting it to our HIPAA-eligible analysis service for processing. We will not use your photograph to train artificial intelligence models, sell it, or share it with marketing partners. See our Privacy Policy for further detail on data handling.
Recommendations and pricing
Any product or in-office treatment recommendations generated by the Service are suggestions and require confirmation by your Elias Dermatology care team during a clinical consultation. Your care team may include a board-certified dermatologist, a physician assistant, or a licensed aesthetician working under physician supervision. Pricing displayed in the Service is approximate; final pricing is established at consultation based on your individual treatment plan.
No warranty
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF RESULTS. ELIAS DERMATOLOGY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM MATERIAL INACCURACIES.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELIAS DERMATOLOGY, ITS OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. THE TOTAL LIABILITY OF ELIAS DERMATOLOGY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED DOLLARS (US $100). Nothing in these Terms limits any liability that may not be limited under applicable law.
Indemnification
You agree to indemnify and hold harmless Elias Dermatology, LLC and its officers, employees, and agents from any claim, demand, loss, or damage (including reasonable attorneys’ fees) arising out of your violation of these Terms or your misuse of the Service.
Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of those courts.
Changes
We may revise these Terms from time to time. We will update the “Last updated” date and, for material changes, provide reasonable notice. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
